1. In case of any dispute with respect to the Promo, including eligibility, claiming of the freebie, the decision of the bank and partner merchant, with the concurrence of DTI shall be considered final.

2. BPI and its subsidiaries as well as its directors, officers and employees are not liable and shall be held rendered free and harmless for any loss or damage (including direct, indirect, and consequential loss) suffered or sustained by the accountholder resulting from the accountholder’s participation in the Program and receipt of the prizes.

3. The prizes of this Promo are non-transferrable and non-convertible in any form.

4. Terms and Conditions governing BPI’s Products, Services, Facilities and Channels, which are made integral parts hereof by reference, shall likewise be resorted to in instances where these are applicable to this Program.

5. The promotion cannot be exchanged for other items or discounts and cannot be used in conjunction with other promotional offers, privileges and VIP/Membership cards of the partner merchants.

6. The promo is not valid in conjunction with any ongoing promos of Merchant. In the purchase of goods and services which are on promotional discount, in compliance to the Expanded Senior Citizen Act of 2010 (R.A. 9994) an Act Expanding Benefits and Privileges of Persons with Disability (PWD) (R.A. 10754), the senior citizen or PWD can avail of the promotional discount or the discount provided under the said laws, whichever is higher, if applicable.

7. In the event of a dispute related solely to the Bank's processes and the customers' participation in this Promo, the Bank will make a decision, with the concurrence of DTI, which will be considered final within the context of this promotional offer. However, if the dispute involves the participating Merchant and its performance and/or delivery of products to customer, subject to the General Provisions set out above, the decision of the Bank and Merchant with the concurrence of DTI shall be considered final. This resolution process does not preclude the customer from pursuing further legal remedies as provided by law.
