1. In case of any dispute with respect to the Promo, including eligibility, redemption of promo deal, the decision of the bank and partner merchant, with the concurrence of DTI shall be considered final.
2. BPI and its subsidiaries as well as its directors, officers and employees are not liable and shall be held rendered free and harmless for any loss or damage (including direct, indirect, and consequential loss) suffered or sustained by the accountholder resulting from the accountholder’s participation in the Program and receipt of the prizes.
3. The prizes of this Promo are non-transferrable and nonconvertible in any form.
4. Terms and Conditions governing BPI’s Products, Services, Facilities and Channels, which are made integral parts hereof by reference, shall likewise be resorted to in instances where these are applicable to this Program.
5. The promotion cannot be exchanged for other items or discounts and cannot be used in conjunction with other promotional offers, privileges and VIP/Membership cards of the partner merchants.
6. In case of dispute with respect to the Bank only and the customers' availment of the promo, the decision of the Bank with the concurrence of DTI shall be considered final. However, if the dispute involves Merchant and its performance and/or delivery of products to customers, subject to the General Provisions set out above, the decision of the Bank and Merchant, with the concurrence of DTI, shall be considered final.
