BPI is the sponsor of the BPI Index series and acts as the index calculating agent.

BPI does not guarantee the accuracy, completeness, timeliness, reliability, or availability of the BPI Index, including their composition, calculation, publication, dissemination, and adjustment, or any data included therein or from which they are based. BPI shall have no liability for any errors, omissions, interruptions, delays, or inaccuracies relating to the BPI Index or any associated data.

To the extent permitted by applicable law, BPI, its directors, officers, employees, authorized representatives, subsidiaries, affiliates, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or similar damages arising from or relating to the use of, or reliance on, the BPI Index or any information derived therefrom, even if advised of the possibility of such damages.
